Florida Eviction Process Step by Step

Proper Statutory Notice

Before filing an eviction lawsuit, Florida law requires specific written notice, including:

  • 3-Day Notice to Pay Rent or Vacate (nonpayment cases)
  • 7-Day Notice to Cure or Vacate (correctable violations)
  • 7-Day Unconditional Quit Notice (non-curable violations)
  • 15-Day Notice of Non-Renewal (month-to-month tenancies)

Improper wording or incorrect timing can invalidate your case. We ensure full compliance with statutory requirements before proceeding.

Filing the Eviction Lawsuit

If the tenant fails to comply with the notice:

  • We file a Complaint for Eviction in County Court
  • Seek unpaid rent and possession
  • Coordinate service of process
  • Monitor statutory response deadlines

In nonpayment cases, tenants generally have five business days to respond and deposit rent into the court registry.

Court Proceedings

If the tenant does not respond or deposit rent:

  • Motion for Default
  • Final Judgment for Possession

Writ of Possession

After judgment, the Clerk issues a Writ of Possession, which is posted by the Sheriff. After 24 hours, the Sheriff may restore possession to the landlord.
